Acceptance of Terms

Welcome to i9 Blinds! These Terms and Conditions ("Terms") govern your use of the i9 Blinds website, located at www.i9blinds.com (the "Website"). Please read the Terms of Use carefully before you start to use the Website. By accessing or using the Website, you agree to comply with and be bound by these Terms. If you do not agree to these Terms, please do not use the Website. 

Changes to Terms

i9 Blinds ("i9 Blinds," "we," "us," or "our") reserves the right to modify, amend, or replace these Terms at any time. Your continued use of the Website following the posting of any changes constitutes your acceptance of those changes. It is your responsibility to review these Terms periodically for updates. 

Access to the Website 

We grant you a limited, non-exclusive, non-transferable, and revocable license to access and use the Website for personal, non-commercial purposes. We reserve the right to modify or discontinue any aspect of the Website at any time without notice. 

Intellectual Property 

The content, design, graphics, text, logos, and other materials on the Website are owned or licensed by i9 Blinds and are protected by copyright, trademark, and other intellectual property laws. You may not reproduce, distribute, modify, or create derivative works from any content on the Website without our prior written consent, except as follows: 

  • Your computer may temporarily store copies of such materials in RAM incidental to your accessing and viewing those materials. 
  • You may store files that are automatically cached by your Web browser for display enhancement purposes. 
  • You may print one copy of a reasonable number of pages of the Website for your own personal, non-commercial use and not for further reproduction, publication or distribution. 
  • If we provide desktop, mobile or other applications for download, you may download a single copy to your computer or mobile device solely for your own personal, non-commercial use, provided you agree to be bound by our end user license agreement for such applications. 
  • If we provide social media features with certain content, you may take such actions as are enabled by such features. 

Your right to use the website will immediately end, and you will be required to either return or destroy any copies you have made of the contents, at our choice, if you print, copy, alter, download, or otherwise use any portion of the website in violation of the Terms of Use. All rights not expressly given by the Company are reserved, and you are not granted any right, title, or interest in or to the Website or any of the content on the Website. Any use of the website that isn't specifically authorized by these terms of use is prohibited and may be against the law in terms of copyright, trademarks, and other matters. 

Prohibited Uses

When using the Website, you agree not to: 

  • Violate any applicable laws or regulations.
  • Engage in any activity that disrupts or interferes with the Website's functionality.
  • Attempt to gain unauthorized access to the Website or its systems.
  • Transmit any harmful code, viruses, or malware.
  • Use the Website for any unlawful or unauthorized purpose. 

Privacy 

Your use of the Website is subject to our Privacy Policy. By using the Website, you consent to the collection and use of your information as described in the Privacy Policy.

The Website may contain links to third-party websites. These links are provided for your convenience, and we do not endorse or control the content of these sites. We are not responsible for the accuracy or legality of any content on third-party sites. 

Sale of Goods

  • i9 Blinds will sell, transfer, and deliver to the Buyer the following goods and services (the 'Goods'): In-Home Sales, Measurement, Design Consultation, and installation of various window coverings and home décor items as specified on the attached Invoice.
  • Customer is responsible for the choice of product, style, color, and controls. The Invoice details your order, the price, and quantity, and other specifications you selected, including but not limited to the types of window coverings, patterns, and colors.
  • All sales are considered final due to the custom nature of the Goods. 
  • Payment in full is required at the time of sale unless special arrangements have been made in advance and in writing. If such arrangements are made, any outstanding balance is due at the time of installation or 30 days after the initial contact has been made to schedule installation. 
  • Customer agrees to pay any fees for returned checks and declined credit card transactions and reasonable attorney fees for any collection. 

Delivery and Installation 

  • Any delivery time provided is an estimate, subject to production and delivery delays out of our control due to reliance on international manufacturers and supply chain providers. Weather, natural disasters, world events, unexpected material backorders, shipping and transport delays, and/or other unanticipated occurrences may affect delivery, and you further understand that full or partial refunds will not be issued.
  • i9 Blinds will coordinate with the Buyer to schedule installation. Delivery and installations shall be conducted during regular business hours. Your windows must be clear and accessible prior to installation. 
  • The Goods will be considered delivered to the Buyer at the Buyer's residence and/or buyer's place of business. 

Cooling Off Period 

The Customer shall have the right to cancel this order prior to midnight of the third business day following the date on this invoice. Any cancellation must be a written notice of cancellation to sales@i9blinds.com with the details. Upon the timely notification of your request to cancel this order, any funds remitted shall be returned within 10 days, and any property left in your possession shall be recovered within 20 days, with the Customer being responsible for the safekeeping of said property and its return in substantially as good condition as when received. 

Disclaimers 

i9 Blinds is not the manufacturer of any window coverings or items of home décor. The customer shall be responsible for reading and being aware of all Warning Labels and all other labels provided by the manufacturer. In no event will i9 Blinds be liable for any direct, indirect, punitive, incidental, special, or consequential damages, to property or life, whatsoever arising out of or connected with the use or misuse of the products. 

Limitation of Liability 

To the extent permitted by law, we will not be liable for any direct, indirect, incidental, or consequential damages related to any service provided under this agreement. 

Modifications 

All modifications must be made in writing. 

Severability 

If any part of this agreement is determined to be invalid or unenforceable by applicable law, then the invalid or unenforceable provision will be deemed superseded by a valid, enforceable provision that most closely matches the intent of the original provision, and the remainder of this agreement will remain in full force and effect. 

Governing Law and Venue 

This agreement and our business relationship will be governed by the laws of the State of Georgia, excluding its conflicts of law provisions. You agree to submit to personal and exclusive jurisdiction of a court of proper jurisdiction to which i9 Blinds is located, and to resolve any dispute or claim arising from this agreement and from our business relationship. 

Refund 

Except as otherwise provided in this Agreement, the deposit is not refunded to the Buyer if this transaction is not completed. 

Claims 

The Buyer's failure to give notice of any claim within 10 days from the date of delivery will constitute an unqualified acceptance of the Goods and a waiver by the Buyer of all claims with respect to the Goods. 

No Questions Asked Warranty 

Some producers and suppliers provide a No Questions Asked Warranty for their items just to our clients. If you select a product that is covered by our warranty program, we will give you further information and specifics about the No Questions Asked Warranty for that product. 

Service Guarantee 

Within the first 365 days following the date of installation, excluding the first week after installation, we will offer three (3) service visits without charge. After the first 365 days, any repairs, replacements, motorization programming, warranty claims, battery replacements, or other services will be provided at the then-applicable service call fee (please provide the applicable call rate). You will also be liable for any additional parts, shipping, and other fees associated with the service visit. Any manufacturer's warranty or No Questions Asked Warranty is not included in our service guarantee.  

Estimated taxes are due. When placing the order, all taxes will be determined and applied. 

Entire Agreement 

The Terms of Use and our Privacy Policy represent the final and full understanding between you and i9 Blinds with regard to the Website, and they supersede any and all prior and contemporaneous written or oral understandings, agreements, representations, and warranties with regard to the Website.
